Businessman and owner of the McDan Shipping Company Limited, Daniel McKorley, has been sued at the High Court in Accra (Lands Division) for allegedly appropriating the land of another person forcibly.
He, together with an alleged accomplice, Joseph Nii Mensah Ashong are alleged to have claimed ownership of the land without any rightful claim to the land.
The plaintiff in the case, Magnus A. L. De Souza wants the court to injunct the two defendants from continued encroachment on the land.
According to the facts of the case, Mr De Souza is the owner of a parcel of land situated at East Legon in the Greater Accra region covering an area of 0.41 acres.
He said he purchased the land from Professor David Kpakpo Acquaye in November 1995 who was granted a 99-year lease by the government of Ghana on March 25, 1977.
Mr De Souza said he has been in possession of the land for over 21 years and has a fence wall around it.
However, he indicated that, the defendants without his consent trespassed unto the land with the first defendant claiming ownership.
He then allegedly sold it to the second defendant [McDan] who has dug foundation trenches and has started construction against the plaintiff’s protest and caution by the police not to build until the litigation is over.
Mr De Souza then sued the defendants when Mr McKorley failed to heed the call of the police.
When the case was called, lawyers of the defendants failed to show up in court. However, Mr De Souza presented his witness statement and it was admitted in court.
The case has been adjourned to July 20, 2023, and the plaintiff’s lawyer has been asked to write to the counsel of the defendants.
Mr De Souza is praying the court’s perpetual injunction against the defendants, assigns, agents and representatives along with compensation for the destruction of property.
Also, he is asking the court to award any other cost it deems fit.
